Your Obligations and Prohibited Conduct
By accessing or conducting transactions on our Website, you agree that you will not, under any circumstances:
Violate any applicable laws, regulations, or our policies, including these T&C.
Upload, post, or transmit any content that is false, inaccurate, misleading, defamatory, infringing, abusive, obscene, or otherwise objectionable.
Introduce or distribute any viruses, malware, worms, trojans, or any other harmful code or technologies that could damage or interfere with the functioning or security of the Website or third-party systems.
Use any automated software, bots, scripts, spiders, or content crawlers to access, monitor, scrape, or copy any part of the Website or its content, except for legitimate use by recognized internet search engines (e.g., Google, Bing, etc.).
Circumvent, disable, or interfere with any security-related features or technical measures implemented to protect the Website or its content.
Use the Website or our services if you are not legally capable of entering into binding contracts (e.g., if you are a minor under the laws of your jurisdiction).
Use false or fraudulent means of payment or otherwise attempt to defraud us or any payment provider.

For customers located in the United States, our products may also be offered on a subscription basis. Any such subscription purchases and related services shall be governed by the Subscription section of these T&C.
Payment
Third-party service providers (such as payment gateways, banks, and currency processors) manage certain aspects of the payment process, including available payment methods, real-time currency conversion, transaction security, and any additional fees applicable to international purchases. These providers operate independently from INSTYTUTUM and are subject to their own legal terms and data protection practices.
By placing an order on our Website, you acknowledge and agree that we do not control and are not responsible for the actions, omissions, or policies of third-party payment providers. It is your sole responsibility to review and accept their respective Terms and Conditions and Privacy Policies before proceeding with payment.
Any disputes, chargebacks, or currency-related issues arising from the payment process should be resolved directly with the relevant third-party provider, unless otherwise required by applicable law.
By purchasing our products on a subscription basis with recurring payments, you expressly agree to automatic recurring billing as described in the “Subscription Terms” section below.
Subscription (United States only)
This section applies exclusively to customers located in the United States.
What is Our Subscription Program
INSTYTUTUM offers a subscription-based delivery service for our products (the “Subscription”). By enrolling in the Subscription, you agree to receive recurring deliveries of selected products at the frequency you choose at checkout.
By purchasing a Subscription, you authorize INSTYTUTUM to automatically charge your selected payment method on a recurring basis at the frequency you select, until you cancel.
Subscription orders are fulfilled on an ongoing basis, and you will be charged for each shipment at the applicable price in effect at the time of each charge. Prices are subject to change with prior notice.
You may cancel your Subscription at any time in accordance with these T&C. Cancellation will take effect at the end of the current billing period, and you will continue to receive Subscription deliveries until that time.
Subscription Availability
Subscription is available for products displayed on the Website. Eligibility to purchase a subscription will be indicated on the relevant product page at the time of purchase.
Certain products may be excluded from the Subscription and may not be eligible for recurring delivery.
Subscription availability may be updated, expanded, or restricted at our sole discretion from time to time. You will be notified in advance of any material changes affecting your active Subscription, where required by applicable law. Additional restrictions may apply, including limitations related to shipping destinations, delivery zones, or applicable regulatory requirements.
Enrollment and Authorization for Recurring Payments
Before completing your Subscription purchase, you are provided with a clear and conspicuous disclosure of all material terms, including product description, price, billing frequency (as selected at checkout), charge amount (as displayed at checkout, including applicable taxes and fees), auto-renewal until cancelled, and cancellation availability via your account settings.
BY COMPLETING YOUR SUBSCRIPTION PURCHASE, YOU AUTHORIZE INSTYTUTUM TO AUTOMATICALLY CHARGE THE DESIGNATED PRICES FOR THE APPLICABLE PRODUCTS TO THE PAYMENT METHOD WE HAVE ON FILE ON A RECURRING BASIS IN ACCORDANCE WITH YOUR SELECTED SUBSCRIPTION PLAN, UNTIL YOU MODIFY OR CANCEL YOUR SUBSCRIPTION AS PROVIDED HEREIN.
You may be asked to actively opt in at checkout by selecting an unchecked checkbox confirming your agreement to recurring billing. Where provided and selected, such a checkbox constitutes your express consent to automatic recurring charges for each billing period until cancelled.
Upon enrollment, you may receive a confirmation email with details of your Subscription, including billing frequency, per-billing-cycle price, next renewal date, and cancellation instructions.
We maintain records of Subscription consent, including transaction data and checkout confirmation details, where required by applicable law.
Shipment
As your Subscription includes recurring product deliveries, products will be shipped automatically according to the delivery frequency selected at checkout.
You may manage your Subscription preferences, including delivery frequency and product selection, through your account settings.
You may receive a notification prior to shipment, giving you the opportunity to review or modify your upcoming Subscription order.
Billing and Charges
Your Subscription renews automatically at the end of each billing cycle on a recurring basis according to the frequency selected at checkout. The first charge is processed at the time of enrollment. Each subsequent charge is processed at the beginning of the next billing cycle. All charges are applied in the currency selected at enrollment and at the price applicable at the time of each charge, unless you are notified otherwise in advance.
For Subscription orders, you will receive a reminder email at least 20 days prior to the renewal date. Such reminders will include the upcoming charge amount, the scheduled billing date, and instructions for managing or cancelling your Subscription.
Payment Method Authorization for Recurring Billing
By providing a payment method and completing a purchase, you agree that INSTYTUTUM may charge the payment method associated with your account for the applicable amounts, including recurring billing in accordance with your Subscription terms.
Where required, you may be asked to provide express consent for recurring payments through an affirmative opt-in action at checkout.
You are responsible for ensuring that your payment method details are accurate and up to date. You may update or change your payment method at any time through your account settings.
If a payment attempt fails (for example, due to insufficient funds or an expired payment method), we may notify you and retry the charge up to three (3) times within a reasonable period. If all retry attempts are unsuccessful, we may suspend your Subscription until a valid payment method is provided. If the payment issue is not resolved, we reserve the right to cancel the Subscription without further charges.
Subscription Management and Cancellation
You may manage your Subscription and cancel future auto-renewals through your account settings or by following the instructions provided in reminder emails.
TO AVOID BEING CHARGED FOR THE NEXT BILLING CYCLE, CANCELLATION MUST BE COMPLETED BEFORE THE DEADLINE STATED IN THE APPLICABLE REMINDER EMAIL. IF YOU DO NOT CANCEL IN TIME, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW, AND YOU WILL BE CHARGED.
Each Subscription renewal generates a separate order. Cancellation of an individual order does not affect the status of your Subscription as a whole, which will remain active and continue to generate future orders unless separately cancelled. Cancellation of your Subscription affects only future billing cycles and does not cancel or modify orders that have already been shipped or are in transit.
Cancellation of your Subscription in its entirety stops all future billing and prevents the creation of new orders within the Subscription. You will not be charged for any future billing cycles after cancellation is confirmed. However, cancellation of your Subscription does not affect your ability to place orders on our Website outside of the Subscription.
If you cancel your Subscription shortly after a payment and before shipment (within a three (3)- calendar-day grace period), your Subscription will be cancelled immediately, and a full refund will be issued within 14 (fourteen) calendar days of approval. Please note that the exact time for the funds to appear in your account may vary depending on your payment provider’s processing time and internal policies.
You may reactivate your Subscription at any time through your Account Settings if you choose to resume recurring deliveries.
Cancellation of Subscription Orders (Full or Partial)
You may cancel your Subscription order at any time up to 24 hours before the next scheduled shipment.
If a Subscription order has not yet been shipped, it may be cancelled and refunded in accordance with these T&S and the applicable Return & Delivery Policy, provided that the cancellation request is submitted before the order has been shipped and/or is in transit.
If a Subscription order has already been shipped or is in transit, it cannot be cancelled. In such cases, you may return the product after delivery in accordance with the standard Returns and Refunds process set out herein or in an applicable Return & Delivery Policy.
If you cancel or refuse an entire Subscription order prior to shipment or delivery, the order may be cancelled in full. Where the order has not yet been shipped, a full refund may be issued. Where the order has been partially or fully shipped or delivered, any refund (if applicable) will be subject to deduction of the value of goods already processed or delivered and any non-recoverable costs incurred, including shipping, handling, and payment processing fees, to the extent permitted by applicable law.
If you cancel or refuse one or more items in a Subscription order while accepting other items in the same order, such partial cancellation shall not entitle you to a full refund of the entire order. In such cases, you may be eligible for a refund only for the cancelled or returned items that have not been shipped, and the remaining items in the order will remain payable.
If you receive a Subscription order and decide to return one or more items after delivery, such returns shall be governed by these T&C and the Return & Delivery Policy. In such cases, refunds (if applicable) will be issued only for items returned in accordance with the Return & Delivery Policy and may be subject to inspection, eligibility requirements, and the deduction of applicable costs, where permitted by law.
Where items are shipped together as part of a single consolidated Subscription order, partial cancellation may require the return of the entire shipment in order to assess eligibility for a refund.
Any refund amounts may be adjusted to reflect the value of items, as well as any non-recoverable costs, including shipping, handling, and/or payment processing fees, etc., to the extent permitted by applicable law.
Nothing in this section limits any mandatory rights granted to consumers under applicable consumer protection laws.
Subscription Changes
We may, at our sole discretion, modify the Subscription, including its features, eligibility, availability, benefits, pricing, or other terms. Any material changes will be communicated to you in advance via email.
Where a change affects the price of your Subscription, including an increase in the product price, we will notify you in advance prior to the next billing cycle. Such notification will include the updated price, the effective date of the change, and clear instructions on how to accept or decline the updated terms.
To continue your Subscription at the updated price, you must provide express confirmation (opt-in) through an affirmative action, such as confirming continuation in your account settings or via a designated checkout flow.
If you do not accept the updated price, your Subscription will not renew for the next billing cycle. The current order will continue to be fulfilled, and any products already paid for will be delivered in accordance with these T&C. No further recurring charges or orders will be processed unless you accept the updated terms. Your Subscription will be cancelled. We will send you a confirmation email regarding such cancellation.
Unauthorized Charges
If you believe a charge was unauthorized or made in error, we recommend contacting us directly at [email protected]. Please include your name, order number (if available), payment method, amount, and charge date.
We will review your request and respond within a reasonable timeframe and may issue a refund if the charge is confirmed to have been made in error.
Upon receiving notice of a dispute or chargeback, we may suspend your Subscription and pause any future charges while the matter is being reviewed in accordance with applicable payment network rules.
Termination By Us
We may suspend or terminate your Subscription and/or your access to your acount at our sole discretion, including but not limited to cases of suspected fraud, abuse, chargeback activity, misuse of the Subscription, or any violation of these T&C, to the extent permitted by applicable law, including but not limited to: repeated refund, return, or cancellation requests inconsistent with normal consumer behavior; attempts to exploit promotional offers, discounts, loyalty benefits or subscription benefits; provision of false, misleading, incomplete, or unauthorized payment or personal information; excessive cancellation, pause, or reactivation patterns; refusal to cooperate with reasonable fraud prevention, verification, or security checks; or any other activity that we reasonably determine to be fraudulent, abusive, manipulative, or inconsistent with fair use of the Subscription.
If we do so, you will only be charged for orders that have already shipped or have been placed and are scheduled to ship in accordance with your Subscription at the time of termination. No additional recurring charges will be processed after termination. Where reasonably practicable, we may notify you in advance of such suspension or termination.
Subscription Liability Limitations
To the extent permitted by applicable law and in addition to the Limitation of Liability set forth in our T&C, we do not guarantee uninterrupted, timely, or error-free fulfillment of Subscription orders. Delays may occur due to, including but not limited to, inventory availability, supply chain disruptions, shipping carriers, customs clearance, or other events outside our reasonable control.
INSTYTUTUM shall not be liable for any delay, non-delivery, or failure to perform Subscription deliveries caused by third-party logistics providers, carriers, or force majeure events.
You are solely responsible for ensuring that your account, shipping, and payment information remain accurate, complete, and up to date. We shall not be liable for any failed deliveries, missed shipments, or service interruptions resulting from incorrect, outdated, or incomplete information you provide.
Our Subscription services rely on third-party providers, including payment processors, inventory systems, and logistics carriers, over which we have no control. Accordingly, we disclaim any liability for acts, omissions, delays, or failures of such third parties, except to the extent such liability cannot be excluded under applicable law.
Contacting You
We may contact you using the contact details you have provided to us (such as your email address, phone number, or shipping address), or other information in our possession, where permitted by law. Any such contact will be conducted in accordance with our Privacy Policy and all applicable data protection laws.
By using our Website, you consent to being contacted for purposes related to your transaction, order status, product feedback, or customer service, in compliance with the above frameworks.
Shipment
Customers are solely responsible for ensuring that the products they order comply with local importation rules and do not require prior registration or authorization. INSTYTUTUM shall not be liable if a product is refused entry by customs or a local health authority in the country of delivery.
Where products are purchased on a Subscription basis (as available to customers in the United States), shipments will be processed in accordance with the applicable Subscription terms in your account and the delivery frequency selected at the time of purchase.
All shipments are sent with tracking. You will receive a dispatch confirmation email containing a tracking code once your order has left our warehouse. To monitor your delivery, please visit the courier’s website and enter your tracking number.
Orders placed before 17:00 CET (Central European Time) (Monday to Thursday) will typically be dispatched the following business day. Estimated delivery timeframe: 7–20 business days, depending on your location.
Shipment, delivery and returns are governed by our applicable Return & Delivery Policy. In the event of any inconsistency between these T&C and the Return & Delivery Policy, the Return & Delivery Policy shall prevail with respect to shipping, delivery, returns, and related procedures in your country or state of residence.
Orders placed between Friday and Sunday may experience a delay in tracking activation of up to 3–4 days. Delivery times remain subject to courier performance and regional conditions.
Important: Please ensure that your phone number is accurate and includes the correct international dialing code. Incomplete or incorrect information may result in delivery delays or cancellation of your order.
Standard Delivery is offered free of charge on all orders over USD 200/EUR 200. In addition, we provide FREE Standard Delivery on your first order, regardless of the amount. Please note that some exceptions may apply — for certain countries or remote delivery zones, shipping charges may still be incurred. We recommend contacting us prior to ordering if you are unsure whether your destination qualifies.
Customers may choose between two global shipping options during checkout: Standard Tracked Delivery and Priority Tracked Delivery. Your selected method, along with the applicable shipping and handling costs, will be shown before you finalize your purchase.
Import taxes, customs duties, or clearance fees imposed by your local authorities are the sole responsibility of the customer. As these charges vary depending on country, product category, and local regulations, INSTYTUTUM does not provide estimates or assume liability for such costs. We advise verifying the import rules applicable in your country before placing an order.
For deliveries to countries outside the European Union and the USA, the customer is exclusively responsible for compliance with local import regulations and for covering any customs or brokerage fees required to release the shipment.
Returns and refunds
For hygiene and safety reasons, we can only accept returns of cosmetic products that are unused, unopened, and in their original packaging, unless the product is faulty or damaged upon delivery. This limitation does not affect your statutory rights under consumer protection laws applicable in your country of residence.
7.1 You have the right to withdraw from your purchase and return unused products within 14 calendar days of receiving your order, without providing any reason. We are also able to offer exchanges within this 14-day period, subject to product availability. Return instructions and a return link will be included in the shipment confirmation email. Use the link that you received with the tracking e-mail.
To initiate a return, please follow these steps:
1. Inspect and document: If the item is damaged, take clear photos of the product showing the damage.
2. Pack the item: Ensure the product is securely packed in a cardboard box to prevent further damage during transit.
3. Ship the item: Send the parcel using a trackable courier to the following return address:

Important: The cost of return shipping is the responsibility of the sender.
5. Assessment and refund: Once our team has inspected the returned item, we will notify you of the outcome.
Once your return has been received and accepted by our warehouse, you will be notified by email.
The refund will be processed via the same payment method you used for the original purchase within 14 (fourteen) calendar days of approval. Please note that the exact time for the funds to appear in your account may vary depending on your payment provider’s processing time and internal policies.
If an order is refused and/or not collected, we may issue a refund reduced by shipping, handling, and return costs incurred, to the extent permitted by applicable law.

We do not accept returns for the following items:
Opened or used products
Products not in original condition, including missing packaging, seals, or protective elements
Gift cards and digital vouchers
Hygiene-sensitive items that cannot be safely resold
Samples, trial-size, or promotional items (if provided free of charge)
Products returned outside the allowed return window
For hygiene and safety reasons, these items are non-returnable.
Items may still be eligible for return in cases of defect, damage during shipping, or incorrect order fulfillment.
For Subscription orders, each shipment is treated as a separate purchase. Cancellation of your Subscription does not automatically cancel or affect orders that have already been shipped, or are in transit at the time of cancellation, in accordance with the Subscription cancellation terms set out in the Subscription section hereof.
Subscription-related deliveries are subject to the same return and refund rules set out in this section.
Limitation of Liability
To the extent permitted by applicable law, INSTYTUTUM and its affiliates shall not be held liable for any direct, indirect, incidental, consequential, punitive, or special damages of any kind, including but not limited to loss of income, profits, business opportunity, goodwill, data, or personal injury arising out of or in connection with your use of the Website, reliance on its content, or purchase and use of our products.
While we take reasonable care in the formulation and safety testing of our cosmetic products, individual reactions to ingredients may vary. You are solely responsible for reviewing the ingredient lists and conducting a patch test before full use. We disclaim liability for allergic or other adverse reactions unless directly attributable to a manufacturing defect or breach of applicable safety or labeling standards.
All content and materials contained on this Website are provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied. We make no representations or warranties regarding the accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, or the absence of viruses or other harmful components.
In jurisdictions where the exclusion or limitation of certain warranties or liabilities is not permitted, our liability shall be limited to the fullest extent permitted by law.
Indemnity
You agree to indemnify, defend, and hold harmless INSTYTUTUM AG, its affiliates, shareholders, directors, officers, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:
your use or misuse of the Website;
your breach of these T&C;
your violation of any applicable law or the rights of a third party.
This indemnification obligation shall survive the termination of these T&C and your use of the Website.
Dispute Resolution and Governing Law
For consumers, the applicable law shall be the law of the country, province, or state of their habitual residence, insofar as mandatory consumer protection provisions apply and cannot be waived by agreement. Nothing in this clause shall limit the rights of consumers under such mandatory laws, including the right to bring claims before a competent court in their local jurisdiction.
For all other users and in all other cases, any dispute, controversy, or claim arising out of or in connection with the use of the Website or any transactions conducted through it, which cannot be satisfactorily settled by correspondence or mutual conference between the parties shall be resolved by arbitration in accordance with the Swiss Rules of International Arbitration of the Swiss Arbitration Centre in force on the date on which the Notice of Arbitration is submitted in accordance with those Rules. The number of arbitrators shall be one; The seat of the arbitration shall be Zurich; The arbitral proceedings shall be conducted in English. Each party shall bear its own legal and procedural costs, unless otherwise determined by the arbitrator.
Notwithstanding the above, INSTYTUTUM reserves the right to seek injunctive or equitable relief in any competent court to prevent actual or threatened misuse of its intellectual property or confidential information.
These T&C, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law rules, except where overriding mandatory provisions of consumer law apply.
Consent to Receive Communications
By providing your email address, telephone number, or other contact information to INSTYTUTUM, you consent to receive communications from us, including by email, push notifications, and automated or non-automated text messages (collectively, “Communications”) at the contact information you provide.
You acknowledge and agree that INSTYTUTUM may send Communications for transactional, operational, customer service, account management, order-related, shipping, subscription, billing, security, and other service-related purposes. Where permitted by applicable law or based on your consent, INSTYTUTUM may also send advertising, marketing, promotional, or other communications regarding products, services, offers, events, or updates.
You may opt out of receiving marketing or promotional emails at any time by using the unsubscribe link included in such Communications or by adjusting your communication preferences in your account settings. You may opt out of marketing text messages by replying STOP, where applicable, or by following any other opt-out instructions provided in the Communication.
Even if you opt out of receiving marketing or promotional Communications, you acknowledge and agree that INSTYTUTUM may continue to send you transactional, relationship, account-related, security, legal, subscription, billing, shipping, customer support, and other non-marketing Communications as permitted by applicable law. Such Communications may be necessary for the administration of your account, fulfillment of orders, provision of services, maintenance of subscriptions, enforcement of these T&C, or protection of INSTYTUTUM’s legitimate business interests.
Severability
If any provision of these T&C is held to be invalid, illegal, or unenforceable by a competent court or authority, that provision shall be deemed severed, and the remainder of these T&C shall remain in full force and effect. Where legally permissible, such invalid or unenforceable provision shall be replaced with a valid and enforceable one that most closely reflects the original intent and commercial purpose of the original provision.
Waiver
No failure or delay by INSTYTUTUM to exercise any right or remedy provided under these T&C or applicable law shall constitute a waiver of that or any other right or remedy. A waiver of any breach or default shall not be deemed a waiver of any subsequent breach or default.
